Terms & Conditions

These terms set out how Tindlewick and its clients work together. Please read them before using our website or requesting a service. By getting in touch with us, you confirm that you have done so.

1. Definitions

Throughout these Terms, the following words carry the meanings given below:

  • "Tindlewick", "we", "us", "our" — the business operating at Level 4, Wisma Sanyan, Jalan Sultan Ismail, 50250 Kuala Lumpur, Malaysia.
  • "Client", "you", "your" — any individual or organisation that contacts us, requests a quote, or engages our services.
  • "Services" — the guest chat review, assistant setup, and guest experience programme offerings described on our website.
  • "Website" — the site accessible at tindlew.club.
  • "Agreement" — these Terms together with any written service confirmation or proposal issued to you.
  • "Content" — text, materials, documents, or data provided by either party in connection with the delivery of Services.

2. Acceptance of Terms

By submitting an enquiry, accepting a proposal, or engaging Tindlewick for any Service, you agree to be bound by these Terms. If you are acting on behalf of a company or organisation, you confirm that you have authority to do so.

Our Services are intended for business use by individuals aged 18 and above. We do not offer services directly to consumers under 18.


3. Service Description and Availability

Tindlewick offers three primary services for hospitality properties:

  • Guest Chat Review (RM 540): Includes a review of typical guest enquiries, a small working sample, and a written summary with discussion of fit.
  • Guest Assistant Setup (RM 1,690): Includes full configuration of a guest assistant, handover design, and a training session for front-office staff.
  • Guest Experience Programme (RM 2,900): A broader engagement covering multiple properties and languages, including a review cycle and a maintenance guide.

Exact scope, deliverables, and timelines will be confirmed in a written proposal prior to commencement. Services are available to properties based in Malaysia, though we may discuss enquiries from other regions on a case-by-case basis.


4. Client Responsibilities

To allow us to carry out our work effectively, you agree to:

  • Provide accurate information about your property, guest enquiry types, and team structure in a timely manner.
  • Make a suitable contact available for questions and review during the engagement period.
  • Ensure that any content you supply (such as FAQ documents or welcome texts) does not infringe the rights of others.
  • Use our outputs — including configuration documents and written summaries — in connection with your own property operations only, unless otherwise agreed in writing.
  • Refrain from using our Website or Services for any unlawful purpose.

5. Intellectual Property

All materials, methodologies, templates, and processes developed by Tindlewick in the course of delivering Services remain our intellectual property unless we explicitly assign them in writing.

Upon full payment for a Service, we grant you a non-exclusive, non-transferable licence to use the deliverables we prepare for your property. This licence is limited to the property or properties covered by the relevant Service and may not be sublicensed, resold, or transferred.

All content on our Website — including text, structure, and design — is owned by Tindlewick. You may not reproduce it without our written permission.


6. Payment Terms

Service fees are as stated on our Website at the time of engagement. All prices are in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated.

  • Payment terms will be specified in your service proposal. Typically, a deposit is required before work begins and the balance is due on completion.
  • Payment may be made by bank transfer or such other method as agreed at the time.
  • Where a service is cancelled by the Client after commencement, reasonable costs incurred up to the point of cancellation may be charged.
  • We reserve the right to pause work on an active engagement if an overdue payment is not addressed within 14 days of a reminder.

Pricing displayed on our Website is indicative. Final pricing is confirmed in a written proposal before any commitment is made.


7. Confidentiality

Each party agrees to treat as confidential any non-public information received from the other party in connection with a Service engagement. This includes internal documents, property data, and commercial terms.

Confidential information will not be disclosed to third parties without prior written consent, except where required by law. This obligation continues for two years after the end of the relevant engagement.


8. Disclaimers

Our Website and the information on it are provided in good faith and to the best of our knowledge. We do not make representations about specific outcomes, guest satisfaction levels, or operational results that may follow from using our Services.

The effectiveness of a guest assistant depends on many factors beyond our work — including your property's communication culture, the quality of information provided, and how it is managed day to day.

We are not a legal, financial, or regulated professional services firm. Nothing on our Website or in our deliverables should be read as professional advice in those areas.


9. Limitation of Liability

To the extent permitted by Malaysian law, Tindlewick's total liability to you — whether in contract, tort, or otherwise — arising from a Service engagement shall not exceed the total fees paid by you for that engagement.

We shall not be liable for any indirect, consequential, or incidental loss, including loss of revenue, loss of goodwill, or loss arising from third-party claims, even where we were aware such losses might occur.


10. Indemnification

You agree to hold Tindlewick harmless from any claims, costs, or damages arising from your misuse of our Services, your breach of these Terms, or any content you supply to us that infringes the rights of a third party.


11. Termination

Either party may end an engagement by giving written notice. If you terminate after work has begun, we will invoice for the portion of the work completed. If we terminate due to a breach on your part, the same applies.

Provisions relating to intellectual property, confidentiality, payment, and liability survive the end of any engagement.


12. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute that cannot be resolved informally will be referred to the courts of Malaysia, to whose jurisdiction both parties submit.

We would always prefer to resolve concerns through direct conversation first. If something is not working as expected, please contact us at [email protected] and we will aim to respond within five business days.


13. General Provisions

  • Entire agreement: These Terms, together with any written proposal we issue, form the complete agreement between us in respect of the relevant Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
  • Waiver: A failure by either party to enforce a provision on one occasion does not waive the right to enforce it on another.
  • Assignment: You may not assign your rights or obligations without our written consent. We may assign ours to a successor business without notice.
  • Notices: Formal notices should be sent by email to the addresses specified in the relevant proposal or, in general matters, to [email protected].

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Engagements already underway will continue under the Terms in effect at their commencement unless both parties agree otherwise in writing.
